Edward Capozzi and Corey Dietz settled a matter involving a 75 year-old Bergen County man who was struck by a motor vehicle in a supermarket parking lot in Saddle Brook, New Jersey. The gentleman was walking from the supermarket to his car when he was struck by the car causing serious spine and leg injuries requiring emergency surgery. At the time of the incident no crosswalks or signs were in place to help control pedestrian traffic and advise motorists to be cautious. The plaintiff also alleged that the defendants had violated the ADA for this failure. The case was settled after two days of mediation bringing the total settlement to $1,275,000.00. Brach Eichler filed suit against the vehicle, the supermarket and the building owner who all contributed to the total.
