The case involved Deborah Nagy, who was injured in 2018 after slipping on a greasy spot on the restaurant floor, resulting in a broken hip and long-term complications, including arthritis.
The jury in Trenton awarded $2.5 million to Deborah and an additional $250,000 to her husband, Roger, for loss of consortium. Before the trial, Outback had offered a settlement of $250,000, which was rejected.
A key point in the case was Outback’s failure to preserve crucial video footage. Though the restaurant admitted liability right before the trial, the judge had earlier ruled that the lost footage could have been used against them. Outback’s admission seemed to be an effort to avoid this potential negative impact on the jury.
